Drug testing at the workplace continues to be a hot-button issue for both employers and employees. Most employers have a drug testing policy in place for their employees but fail to fully understand their rights as an employer and the limitations on drug testing imposed by a spider-web of laws.
Whether a drug testing policy is formally written and distributed to employees or informally administered when necessary, employers must understand the balance between their right to test employees to ensure a safe workplace and their employees' rights in the face of drug testing.
